Code of Content and Conduct of Kingsoft Office
Kingsoft Office is dedicated to creating a clean and healthy cyberspace. To protect your legitimate rights and interests when you use Kingsoft Office online services, Kingsoft Office formulates this Code in accordance with the relevant laws and regulations, the Kingsoft Office Online Service Agreement and other agreements and rules.
I. Code of Content
Kingsoft Office encourages you to fully use the Kingsoft Office online services to freely produce, reproduce, publish and transmit your own information, including but not limited to your registration information of Kingsoft Office online service account such as avatar, nickname and description, the content sent such as authentication data, text, documentation, picture, audio & video and link, and other content deriving from the use of Kingsoft Office online service account (the “Content”).
1. You shall not produce, reproduce, publish or transmit the following Content in violation of laws and regulations: 1.1. opposing the basic principles as established by the Constitution;
1.2. endangering the security of the nation, divulging state secrets, subverting state power, undermining the integrity of the nation’s unity;
1.3. harming the honor and interests of the nation;
1.4. distorting, defaming, desecrating, or denying the deeds and spirit of heroes and martyrs, or insulting, defaming, or otherwise infringing upon the name, portrait, reputation, or honor of a hero or a martyr;
1.5. advocating terrorism or extremism, or instigating any terrorist or extremist activity;
1.6. inciting hatred or racism against peoples to undermine the solidarity of peoples;
1.7. disrupting national policies on religion, propagating evil cults and feudal superstitions;
1.8. spreading rumors, or disturbing economic and social order;
1.9. spreading obscenity, pornography, gambling, violence, murder, terror, or abetting the commission of a crime;
1.10. insulting or defaming other people, infringing on the reputation, privacy and other legitimate rights and interests of other people;
1.11. other content prohibited by laws and administrative regulations.
2. You shall consciously prevent and resist the production, reproduction and transmission of any malicious information containing the following content: 2.1. making improper comments on natural disasters, major accidents and other disaster;
2.2. containing sexual innuendo, sexual provocations, and other information that easily leads to sexual fantasy;
2.3. showing bloodiness, horror, cruelty, and other scenes that cause physical and mental discomfort;
2.4. inciting discrimination among communities or regions;
2.5. promoting indecency, vulgarity and kitsch;
2.6. inducing minors to imitate unsafe behavior, violate social morality, or induce minors to indulge in unhealthy habits;
2.7. other contents that adversely affect network ecology.
II. Code of Conduct
Kingsoft Office prohibits all acts that infringe on the legitimate rights and interests of other people, including but not limited to:
1. Infringement on individual privacy
1.1. using another person’s information/posing as another person or publishing another person’s privacy information without authorization;
1.2. maliciously disseminating the content that infringes on other people’s privacy information.
2. Infringement on intellectual property rights and other rights
2.1. publishing, without authorization, the content that infringes on the legitimate rights and interests of other people, such as interests in copyrights and patent rights;
2.2. disclosing trade secrets or other confidential information without authorization;
2.3. publishing the content to deliberately disseminate the information regarding fake goods;
2.4. publishing untruthful remarks and spreading false information and other content damaging other people’s reputation.
III. Handling of non-compliances
1. You agree and accept that Kingsoft Office will, in accordance with the provisions of the relevant laws and regulations as well as national policies or the requirement of the relevant competent authorities, supervise your publication and dissemination of the content through using Kingsoft Office online services, and take corresponding actions in accordance with the law and this Code, including stopping transmission of any Content prohibited by this Code, retaining relevant records and reporting to the competent authority.
2. If you violate laws and regulations, infringe on the legitimate rights and interests of a third party or breach this Code and relevant agreements, conventions and rules, including those violations that are discovered by Kingsoft Office or of which Kingsoft Office is aware through receiving reports/complaints from other people, then Kingsoft Office will be entitled to take such measures as verification of relevant reports/complaints, notice forwarding and block in accordance with the provisions of the relevant laws and regulations, and to suspend or terminate offering relevant services, including but not limited to making documents unable to be opened or shared, or blocking account.
3. Regarding whether a user’s act violates the provisions of this Code, Kingsoft Office will use its best efforts to make a judgment in accordance with the laws and regulations, but we will not guarantee that such judgment is in full accord with the judgment made by the judicial and administrative organs.
IV. Guidelines for Reports/Complaints and Appeals
- 1.
Guidelines for Reports/Complaints:
- 1.1.
Non-infringement reports:
- 1.1.1.
You can report any illegal and malicious information such as political, pornographic and vulgar, violent, terrible and criminal content (collectively, the “Non-Infringement Information”) by clicking the reporting interface in the article.
- 1.2.
Infringement complaints:
- 1.2.1.
To quickly and efficiently resolve disputes, Kingsoft Office suggests that the right holder should first consult with the counterpart for resolution in respect of any content that infringes on the rights to privacy and reputation, copyrights and other legitimate rights and interests of others (collectively, the “Infringement Information”), and if the right holder cannot contact the counterpart or the consultation fails, you may make a complaint via email to wps@wps.cn.
- 1.2.2.
If you make a complaint, you will be required to be the infringed person or obtain the delegated authority and provide relevant materials, and Kingsoft Office will handle your complaint in a safe and reliable manner in strict compliance with laws and regulations and in light of principle of privacy protection principle.
- 1.2.3.
You are required to provide the subject information and relevant materials, including:
- 1.2.3.1
name, contact information, copy of business license (with the corporate seal, in case of an entity), copy of ID card (with the ID card holder’s own signature, in case of an individual), relevant certificate of authority and other materials that prove the legal status;
- 1.2.3.2
If you accept another person’s entrustment to make a complaint as an agent, you shall also provide the power of attorney issued by the principal and other materials that prove the legal status of your principal;
- 1.2.4.
You are required to provide the preliminary evidence that the content complained about constitutes an infringement:
- 1.2.4.1
In respect of any complaint related to copyright infringement, you shall provide the certificates that the right holder has the ownership of copyright, including but not limited to the copyright certificate issued by the competent authority, proof of the date of first publication or release of the work, creation manuscript, the timestamp of the work issued by an authoritative institution, work filing certificate and other valid proof of ownership that the right holder has the relevant rights;
- 1.2.4.2
For any complaint related to the reputation, privacy and other civil law rights, you shall provide, among other things, preliminary evidence that the content published by the accused constitutes an infringement of the right holder’s reputation, privacy and other rights.
- 1.2.5.
You are required to provide the accurate name and network address of the content you request disconnecting.
- 1.2.6.
Given that the complexity of infringement complaints is different, if Kingsoft Office discovers any problem in materials upon review and cannot directly determine such problem, we will timely notify you via email for rectification, please check the email at any time.
- 1.2.7.
After receiving the complaint notice meeting the requirement, Kingsoft Office as a neutral network service providers will be entitled to, in accordance with the relevant laws and regulations, forward all or part of the complaint notice given by you to the accused.
- 1.2.8.
f the accused does not recognize your complaint and make an appeal to Kingsoft Office, Kingsoft Office will forward the appeal materials submitted by the accused to you. If you have an objection to the opinions and appeal materials submitted by the accused, you shall, within 15 days, make a complaint or initiate a lawsuit with the relevant authority and provide Kingsoft Office with the materials including complaint/lawsuit acceptance notice. If you fail to provide such materials on time, Kingsoft Office will be entitled to release the handling of the relevant content.
- 1.2.9.
You and the right holder know and understand that the infringement complaint is a serious legal act and Kingsoft Office will conduct evaluation and review in accordance with the laws and regulations and based on the content complained about and evidence, and do its best to safeguard the legitimate rights and interests of each right holder. Regarding any infringement complaint, you warrant that:
- 1.2.9.1
The statements made in the complaint and the relevant materials provided by you are true, valid and legal, and that you are willing to bear all legal consequences for Kingsoft Office’s handling of the content complained by you.
- 1.2.9.2
You and the right holder will not abuse the complaint, including but not limited to maliciously making repeated complaints in respect of the same infringement fact, making complaints in batches to increase the system load, making complaints maliciously with the knowledge that the content accused of infringement does not constitute an infringement or there is obviously no factual basis, or providing false statements and materials.
- 1.2.10.
You know and acknowledge that if you breach the warranties mentioned above, upon discovery of such breach, the relevant complaint will be deemed invalid and Kingsoft Office will not accept or handle such complaint.
- 2.
Guidelines for Appeals:
- 2.1.
If the content that you publish or disseminate through using Kingsoft Office online services is handled due to being suspected of containing illegal and malicious information, and if you have an objection to the handling results, you may give an explanation by making an appeal or contacting service hotline (at 400-677-5008) and Kingsoft Office will designate a special person to verify the relevant content.
- 2.2.
If the content that you publish and disseminate through using Kingsoft Office online services is accused by the relevant right holder of infringement and you do not recognize the infringement, you may make an appeal by sending written explanatory documents to wps@wps.cn.
- 2.3.
You are required to provide the subject information and relevant materials, including: name, contact information, copy of business license (with the corporate seal, in case of an entity), copy of identity card (with the ID card holder’s own signature, in case of an individual), relevant certificate of authority and other materials that prove the legal status;
- 2.4.
You shall provide the preliminary evidence proving non-infringement.
- 2.4.1
In respect of any appeal against the copyright infringement complaint, you shall provide the certificates that the right holder has the ownership of copyright, including but not limited to the copyright certificate issued by the competent authority, certificates of trademark rights and patent rights, proof of the date of first publication or release of the work, creation manuscript, the timestamp of the work issued by an authoritative institution, work filing certificate and other valid proof of ownership that the right holder has the relevant rights.
- 2.4.2
For any appeal against the complaint in relation to the reputation, privacy and other civil law rights, you shall provide the relevant valid proof that there is no infringement fact.
- 2.4.3
You are required to provide the accurate name and network address of the content you request restoring.
- 2.5.
Given that the complexity of infringement complaints is different, if Kingsoft Office discovers any problem in materials upon review and cannot directly determine such problem, we will timely notify you via email for rectification, please check the email at any time.
- 2.6.
After receiving the appeal materials, Kingsoft Office as a neutral network service providers will be entitled to, in accordance with the relevant laws and regulations, forward the appeal materials submitted by you to the accuser, and notify that the accuser shall, within 15 days, make a complaint or initiate a lawsuit with the relevant authority and provide Kingsoft Office with the materials including complaint/lawsuit acceptance notice. If the accuser fails to provide such materials on time, Kingsoft Office will be entitled to release the restrictions on the relevant content. If the accuser provides such materials on time, Kingsoft Office will directly forward them to the appellant and maintain the handling of the relevant content.
For ease of reading and understanding, this Code will be translated into multiple versions in other languages, and in case of any conflict between different versions, the Simplified Chinese version of this Code shall prevail.
